These terms describe how you may use the Pastry Embassy website, how we handle custom-cake inquiries and quotes, and the basics of ordering, pickup, and payment.

Section 01

Agreement to these terms

These Terms apply when you use this website, submit an inquiry, request a quote, place an order, pay an invoice, pick up an order, receive delivery, or otherwise buy from Pastry Embassy.

By using the website or placing an order, you agree to these Terms and to any written quote, invoice, Square checkout terms, pickup instructions, delivery instructions, or product-specific policy provided with your order. If a written quote or invoice has more specific terms for a custom, wedding, corporate, or catering order, those specific terms control for that order.

These Terms are written for a Texas food service business and are intended to protect both the customer and the owner by making expectations clear before an order is accepted.

Section 02

Website information

The website is a storefront, menu guide, and inquiry channel. We try to keep information accurate, but menu items, photos, prices, sizes, ingredients, flavors, designs, availability, hours, and pickup or delivery options may change without notice.

Photos are examples of style, quality, and presentation. Natural variation is part of handmade pastry work. Actual color, shape, size, decoration, packaging, and finish may vary because desserts are made by hand and may be affected by ingredient supply, weather, humidity, transport, and design constraints.

The case, Square checkout, a confirmed quote, or a written invoice is the controlling source for the final product, price, tax, timing, and fulfillment method.

Section 03

Orders and acceptance

An order or inquiry is not accepted until we confirm it or Square confirms it through the applicable ordering flow. We may decline, cancel, modify, or limit an order when reasonably necessary, including because of capacity, ingredient availability, timing, payment risk, inaccurate information, unsafe delivery conditions, suspected fraud, abusive conduct, or a request we cannot responsibly fulfill.

Customers are responsible for providing accurate names, phone numbers, email addresses, pickup times, delivery addresses, event dates, design instructions, allergy information, and other order details. We are not responsible for delays, missed communications, failed receipts, missed pickups, delivery problems, or design issues caused by incorrect or incomplete customer information.

Section 04

Payment

Prices are in U.S. dollars. Taxes, fees, delivery charges, tips, and other charges may be added where applicable. Payment may be processed by Square or another payment provider. Their terms apply to the payment transaction, hosted checkout, receipts, fraud review, chargebacks, refunds, saved payment methods, and payment security.

We do not store full card numbers. A payment, deposit, or invoice may be required before an order is booked or production begins. Failure to pay by the stated deadline may result in cancellation or release of the reserved production time.

Section 05

Custom cakes and special orders

Custom cake, wedding cake, corporate, catering, and event requests are inquiries until accepted in writing. A quote becomes a confirmed booking only after we confirm availability, agree on the scope, and receive any required payment or deposit.

Reference photos are inspiration only. We do not promise exact duplication of another baker's work, copyrighted designs, trademarked characters, protected logos, venue decor, flowers, colors, fonts, finishes, or AI-generated images. Final designs are our professional interpretation of the agreed request.

Customer changes must be requested in writing. We may approve or decline changes based on timing, materials, design feasibility, and production capacity. Changes may increase the price or require a new pickup or delivery time.

Section 06

Intellectual property and customer materials

The Pastry Embassy name, logo, website text, photography, product names, designs, and brand materials are owned by Pastry Embassy or its licensors. You may not copy, sell, scrape, repackage, or use them for another business without permission.

If you upload or send photos, designs, logos, characters, text, artwork, or other materials, you represent that you have the right to share them with us for the purpose of reviewing, quoting, producing, documenting, or defending the order. You agree to indemnify us for claims arising from materials you provide.

We may photograph products we make and use those photos for our portfolio, social media, website, training, advertising, or records, unless we agree in writing not to do so before the order is produced. We will not intentionally publish private contact information with portfolio photos.

Section 07

Allergens and ingredients

Our products may contain or come into contact with common allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, sesame, and other ingredients. We operate in a kitchen where cross-contact can occur.

We may discuss ingredient preferences and allergy concerns, but we do not guarantee an allergen-free environment unless a specific written agreement says otherwise. Customers with severe allergies should contact us before ordering and should make their own safety decision.

Ingredient lists, flavors, and decorations may change because of availability or supplier changes. Decorative items, toppers, flowers, candles, dowels, supports, ribbons, packaging, or non-edible decorations may be included and must be removed before serving where applicable.

Section 08

Pickup

Orders must be picked up at the scheduled location and time. Desserts are perishable and may be temperature-sensitive. Once an order is picked up, the customer accepts responsibility for transport, handling, storage, refrigeration, display, serving, and any damage after pickup.

Please inspect your order at pickup. If there is a visible issue, tell us before leaving so we have a fair opportunity to evaluate and address it. We may not be able to verify or fix complaints reported after the product has left our control.

Orders not picked up on time may be held only as long as practical and safe. Perishable orders may be discarded, donated, or otherwise handled at our discretion if not picked up within a reasonable time. Missed pickups are not automatically eligible for refund.

Section 09

Delivery

Delivery may be offered only where available and may be handled by Pastry Embassy, Square, a courier, or another third party. Delivery times are estimates unless expressly guaranteed in writing.

The customer is responsible for providing a complete and accurate delivery address, contact phone, gate code, building access, parking instructions, and an authorized recipient. Failed delivery caused by wrong information, inaccessible location, no recipient, unsafe conditions, refusal, or customer unavailability may be treated as completed or may require an additional fee.

Risk of loss may pass to the customer when the order is delivered to the address, handed to the recipient, left according to instructions, or transferred to a courier, depending on the fulfillment method. Weather, traffic, courier availability, building access, and customer delays can affect delivery.

Section 10

Storage and handling after pickup or delivery

Many pastries and cakes require careful handling. Keep products level, cool, protected from direct sun, and away from heat. Do not leave desserts in a parked car or outdoors in Texas heat. Follow any storage, refrigeration, display, cutting, or serving instructions we provide.

We are not responsible for melting, cracking, sliding, collapsing, color transfer, condensation, spoilage, or damage caused by customer transport, storage, setup, display conditions, weather, heat, refrigeration, freezing, handling, or delayed service after pickup or delivery.

Section 11

Cancellations, refunds, and credits

Because pastries, custom cakes, and event orders are perishable and often prepared to order, refunds are limited.

  • Standard menu orders may be cancelled for a refund only if cancellation is requested before production begins or within the cancellation window shown in Square or the written confirmation.
  • Same-day, rush, seasonal, holiday, limited-quantity, and perishable items may be final sale once accepted or prepared.
  • Custom cakes and special orders may require a non-refundable deposit because we reserve production time, purchase ingredients, create designs, and may turn away other work.
  • Custom cake cancellations requested after production, design work, ingredient purchasing, or the stated deadline may be partially refundable, non-refundable, or eligible only for store credit at our discretion.
  • Wedding, corporate, catering, and large event orders are governed by the cancellation terms in the written quote or invoice.
  • Refunds, when approved, are usually returned to the original payment method through Square or the original payment provider. Processing times are controlled by banks and payment providers.

If we make a material mistake, we may choose an appropriate remedy based on the circumstances, such as repair, replacement, partial refund, store credit, or refund. We may require photos, return of the unused portion, receipt, order number, and prompt notice so we can evaluate the issue.

Section 12

Complaints and dispute documentation

To preserve evidence and give us a fair chance to help, product complaints must be reported as soon as possible, preferably the same day and before the product is served or discarded. Include the order number, clear photos, a description of the issue, storage and transport details, and whether any portion has been consumed or altered.

Eating, serving, discarding, modifying, or failing to preserve the product may limit available remedies because it prevents inspection. Chargebacks or payment disputes should not be used as a substitute for contacting us first, unless required by your card issuer.

Section 13

Conduct and safety

We may refuse service, cancel orders, block communications, or require written-only communication if a customer or representative is abusive, threatening, harassing, discriminatory, fraudulent, unsafe, intoxicated, or disruptive.

We may also refuse requests that are illegal, unsafe, misleading, infringe intellectual property, contain hate or harassment, require deceptive health claims, or conflict with food safety or business standards.

Section 14

Third-party services

Square, Google (including Drive, Sheets, and Maps), Cloudflare, social media platforms, delivery partners, and other third-party services may be used in connection with this website or our operations. Their terms, policies, fees, limitations, security practices, and availability apply to their services.

We are not responsible for third-party outages, account issues, payment holds, courier conduct, map errors, authentication requirements, platform changes, or policies outside our control.

Section 15

No warranties

The website and products are provided as available. To the fullest extent allowed by law, we disclaim implied warranties not expressly required by law, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted website access.

Nothing in these Terms limits rights that cannot legally be limited, including rights under applicable food safety, consumer protection, or payment laws.

Section 16

Limitation of liability

To the fullest extent allowed by law, Pastry Embassy, its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, punitive, lost profit, lost business, emotional distress, event disruption, reputational, or similar damages.

To the fullest extent allowed by law, our total liability for any order-related claim is limited to the amount paid to Pastry Embassy for the specific product or order giving rise to the claim. This limitation does not apply where prohibited by law.

Section 17

Indemnity

You agree to indemnify and hold Pastry Embassy, its owners, employees, contractors, and service providers harmless from claims, losses, damages, fees, costs, and expenses arising from your misuse of the website, inaccurate order information, unsafe handling after pickup or delivery, materials you provide, intellectual property claims based on your requested design, violation of these Terms, or violation of law.

Section 18

Governing law and venue

These Terms and any dispute involving Pastry Embassy are governed by the laws of the State of Texas, without regard to conflict-of-law rules.

To the fullest extent allowed by law, any lawsuit or court proceeding must be brought in the state or federal courts located in Harris County, Texas, and each party consents to personal jurisdiction and venue there.

Before filing a lawsuit, the parties agree to make a good-faith effort to resolve the dispute informally by written notice describing the issue, requested remedy, order number, and supporting evidence.

Section 19

Changes

We may update these Terms as our website, ordering process, policies, providers, or legal obligations change. Updated Terms will be posted on this page. Terms in a signed or written quote may continue to apply to the order they were issued for.
